EU WEEE Compliance

Under the Waste Electrical and Electronic Equipment (WEEE) Directive and implementing regulations, when customers buy new electrical and electronic equipment from Waters they are entitled to:

  • send old equipment for recycling on a one-for-one, like-for-like basis (this varies depending on the country)
  • send the new equipment back for recycling when this ultimately becomes waste

Collection and Recycling Arrangements in Austria

Under the Austrian Ordinance on Waste Prevention, Collection and Treatment of Waste Electrical and Electronic Equipment (WEEE Ordinance) that came into force on August 13th 2005, for equipment that you buy from Waters after August 13th 2005, Waters is required to finance the collection, treatment, recycling, and recovery of WEEE that your new purchase replaces, on a one-for-one, like-for-like basis. The old equipment that your new purchase from Waters replaces is referred to as Historic WEEE.

Under the Decree, Waters is also required to provide arrangements for the collection, treatment, recycling, and recovery of any new electrical and electronic equipment that you buy from Waters after August 13th 2005, when that new equipment eventually becomes waste. This is referred to as New WEEE.

Waters meets its obligation to the Austrian WEEE Regulations to finance the take-back and recycling of Waters electronic products though membership to local compliance scheme Elektro Recycling Austria GmbH (ERA).

Collection and Recycling Arrangements in Belgium

Under the Regulations concerning the management of waste electrical and electronic equipment (WEEE) in each of the three regions of Belgium, for equipment that you buy from Waters after August 13th 2005, Waters is required to provide arrangements for the collection, treatment, recycling, and recovery of WEEE that your new purchase replaces, on a one-for-one, like-for-like basis. The old equipment that your new purchase from Waters replaces is referred to as Historic WEEE.

Under the WEEE Act, Waters is required to provide arrangements for the collection, treatment, recycling and recovery of any new electrical and electronic equipment that you buy from Waters after August 13th 2005, when that new equipment eventually becomes waste. This is referred to as New WEEE.

Waters meets its obligation to the Belgian WEEE Regulations to finance the take-back and recycling of Waters electronic products though membership to local compliance scheme Recupel.

Under Act 352/2005 on the details of management of waste electrical and electronic equipment (WEEE), for equipment that you buy from Waters after August 13th 2005, Waters is required to finance the collection, treatment, recycling, and recovery of WEEE that your new purchase replaces, on a one-for-one, like-for-like basis. The old equipment that your new purchase from Waters replaces is referred to as Historic WEEE.

The WEEE Directive is transposed by the Danish Order for WEEE which came into force on August 1st 2005. Under this Order, for equipment that you buy from Waters after April 1st 2006, Waters is required to provide arrangements for the collection, treatment, recycling, and recovery of the waste electrical and electronic equipment (WEEE) that your new purchase replaces, on a one-for-one, like-for-like basis. The old equipment that your new purchase from Waters replaces is referred to as Historic WEEE.

Under the Order, Waters is also required to provide arrangements for the collection, treatment, recycling, and recovery of any new electrical and electronic equipment that you buy from Waters after April 1st 2006, when that new equipment eventually becomes waste. This is referred to as New WEEE.

Under the French Decree on Electrical and Electronic Equipment and Management of its Waste which came into force on August 13th 2005, the financing of collection and recycling of any waste electrical and electronic equipment (WEEE) arising from equipment bought before August 13th 2005 is the customer's responsibility. This is regardless of whether the equipment is being replaced by a new piece of equipment from Waters. The old equipment that your new purchase from Waters replaces is referred to as Historic WEEE.

Under the Decree, Waters is also required to provide arrangements for the collection, treatment, recycling, and recovery of any new electrical and electronic equipment that you buy from Waters after August 13th 2005, when that new equipment eventually becomes waste. Collection and Recycling Arrangements in Germany

Under the Germany Act Governing the Sale, Return and Environmentally Sound Disposal of Electrical and Electronic Equipment (ElektroG) which came into force on August 13th 2005, the financing of collection and recycling of any waste electrical and electronic equipment (WEEE) arising from equipment bought before March 24th 2006 is the customer's responsibility. This is regardless of whether the old equipment is being replaced by a new item of equipment purchased from Waters. Waste arising from equipment purchased before March 24th 2006 is referred to as Historic WEEE.

Under the ElektroG Act, Waters is required to provide arrangements for the collection, treatment, recycling, and recovery of any new electrical and electronic equipment that you buy from Waters after March 24th 2006, when that new equipment eventually becomes waste. This is referred to as New WEEE.

The Under the Hungarian WEEE Management Decree 264/2004 which came into force on September 23rd 2004, for certain equipment that you buy from Waters after August 13th 2005, Waters is required to provide arrangements for the collection, treatment, recycling, and recovery of the waste electrical and electronic equipment (WEEE) that your new purchase replaces, on a one-for-one, like-for-like basis. The old equipment that your new purchase from Waters replaces is referred to as Historic WEEE.

Under SI 340/2005 Waste Management (Waste Electrical and Electronic Equipment [WEEE]) Regulations which came into force on August 13th 2005, for equipment that you buy from Waters after August 13th 2005, Waters is required to provide arrangements for the collection, treatment, recycling, and recovery of WEEE that your new purchase replaces, on a one-for-one, like-for-like basis. The old equipment that your new purchase from Waters replaces is referred to as Historic WEEE.

Under the Regulations, Waters is also required to provide arrangements for the collection, treatment, recycling, and recovery of any new electrical and electronic equipment that you buy from Waters after August 13th 2005, when that new equipment eventually becomes waste. This is referred to as New WEEE.

Waters products are very competitively priced. Any new increase in operating costs for manufacturers such as Waters is normally reflected in a price increase in the product. However, instead of increasing the prices of our products, Waters has decided to share these new environmental costs directly with our customers. We believe in being transparent with you on any new environmental costs that our products need to address.

Our approach to sharing these new environmental costs is:

  • Waters pays for the costs of treatment, recycling, and recovery of the WEEE to meet the targets set by the Waste Management (WEEE) Regulations
  • Waters pays for the costs of data management and reporting to the WEEE Register Society to demonstrate compliance with all administrative requirements of the Waste Management (WEEE) Regulations
  • you pay for transportation of your WEEE to Waters's appointed recycler in Ireland

Waters has established a recycling contract with the European Advanced Recycling Network (EARN) and will cover any costs of treatment, recycling, and recovery of the equipment on arrival at the EARN recycling facility in Ireland. All New WEEE that arises from the purchase of Waters products is classed as non-hazardous waste.

It is your responsibility to arrange and pay for costs of collection and transportation to the recycler. Under the Waste Management Act 1996, you should use the following carrier (which holds a valid Waste Carriers licence):

There is no legal requirement that WEEE be accompanied by documentation when transported in Ireland. However, in order to enable EARN to identify Waters equipment upon arrival at the recycler's address, please download the Recycling Label for Irish Customers. Complete the label with your company details and attach it to a suitable box for transport to EARN.

WEEE Reporting Recycling Data for Waters Equipment in Ireland

Under Part 3 Section 28 of the Waste Management (WEEE) Regulations, Waters must provide annual information on the quantities and categories of electrical and electronic equipment put on the market, reused, recycled, and recovered within Ireland.

The first WEEE recycling report will cover the year 2011. EARN will prepare the recycling data report for Waters. Information in the EARN recycling data report will be summarised on the Waters website when it becomes available.

Collection and Recycling Arrangements in the Netherlands

Under the Dutch Waste Electrical and Electronic Equipment (WEEE) Management Regulations which came into force on January 1st 2005, Waters is responsible for the financing of collection and recycling of the following equipment:

  • Any electrical and electronic equipment that you bought from Waters before August 13th 2005 (referred to as Historic WEEE), which is being replaced by a new piece of equipment bought from Waters; and
  • Any new electrical and electronic equipment that you buy from Waters after August 13th 2005, when that new equipment eventually becomes waste (referred to as New WEEE).

For any other waste electrical and electronic equipment bought before August 13th 2005 which is being replaced by an item of Waters electrical and electronic equipment, the environmentally sound disposal of this other equipment is the customer’s responsibility.

Waters meets its obligation to the Dutch WEEE Regulations to finance the take-back and recycling of Waters electronic products though membership to local compliance scheme Recycling Technologische Apparatuur (RTA).

Collection and Recycling Arrangements in Norway

The Waste Electrical and Electronic Equipment (WEEE) Directive is a European Directive which requires producers to make arrangements for the collection and recycling of WEEE. The Directive is transposed into national law by EU Member States. Norway is not a member of the European Union and therefore has no obligation to follow the WEEE Directive. However, similar legislation is in force in this country.

As part of the regulatory system in Norway, the Ministry of Environment has approved two large collective compliance schemes (El-Retur and RENAS which between them account for 94% of WEEE collection and recycling in Norway) and a smaller compliance scheme (Eurovironment which is run by 14 producers of IT equipment)

Collection and Recycling Arrangements in Switzerland

The Waste Electrical and Electronic Equipment (WEEE) Directive is a European Directive which requires producers to make arrangements for the collection and recycling of WEEE. Switzerland is not a member of the European Union or of the European Economic Area, and therefore has no obligation to follow EU policy.

Producer responsibility for the take-back of electrical and electronic equipment in Switzerland is covered by the Ordinance on the Return, Take-back and Disposal of Electrical and Electronic Equipment (ORDEE). The Ordinance came into force on July 1st 1998 and an amendment came into force in January 2005 which extended the scope of the Ordinance to increase the number of categories of electrical and electronic equipment which are covered.
